Terms of Use

Billy Atlas is a discovery and introduction platform for creators and brands. Creators build a public Partnership Profile and media kit. Brands write a plain-English campaign brief and receive a recommended shortlist of creators, with reasoning, based on the information available to us.

We help two sides find each other and start a conversation. What happens after that — negotiating a deal, agreeing rates, signing a contract, delivering content, paying invoices — happens directly between the brand and the creator, off-platform.

What we expressly don't do

• We are not a party to any agreement a brand and creator reach with each other.
• We do not process, hold or guarantee any campaign payment between brands and creators.
• We do not sign, hold or enforce campaign contracts.
• We do not act as agent, manager or employer for any creator, and we do not act as agent for any brand.
• We do not verify every claim a user makes on the Platform, unless a specific item is expressly labelled as verified by Billy Atlas.
• We do not guarantee that any introduction will lead to a response, a booking, revenue or any particular result.

You must be at least 18 to create an account. If you're using the Platform on behalf of a business or other organisation, you're confirming you have the authority to bind that business to these Terms, and "you" includes that business.

You need legal capacity to enter into a binding contract in Australia. By accepting these Terms, you're confirming that's the case for you.

• You're responsible for the accuracy of the information you provide when creating and maintaining your account.
• You're responsible for keeping your login credentials secure and for all activity that happens under your account.
• Tell us at support@billyatlas.com as soon as you become aware of any unauthorised use of your account.
• One account per person or business, unless we agree otherwise in writing.

The Platform has two account roles: creator and brand. Depending on which one you hold, additional terms apply to you specifically — the Creator Terms or the Brand Terms — and form part of your agreement with us alongside these Terms of Use.

Paid plans (Creator+ and Brand Pro) are also subject to our Subscription Terms, which cover pricing, billing and cancellation.

Use the Platform for its intended purpose: building a genuine creator profile, writing genuine brand briefs, and communicating honestly with the other side. Our Acceptable Use Policy sets out the detailed rules on prohibited conduct, and forms part of these Terms. If there's ever a conflict on a specific point, the Acceptable Use Policy governs conduct-related questions.

• Don't misrepresent who you are or who you represent.
• Don't use the Platform to harass, spam, defraud or mislead another user.
• Don't attempt to circumvent security features, scrape data, or interfere with the Platform's normal operation.
• Don't use the Platform for any purpose that's unlawful under Australian law.

You keep ownership of the content you upload — your Partnership Profile, media kit, brand brief, messages and anything else you add. We don't claim ownership of it.

To operate the Platform, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display and distribute your content, solely for the purpose of running the Platform — showing your profile to relevant brands, showing a brief to relevant creators, and similar functions. That licence ends when you delete the content or close your account, subject to reasonable technical delay and any copies kept for legal or record-keeping reasons.

You confirm you have the rights needed to upload what you upload, and that doing so doesn't infringe anyone else's rights.

The Billy Atlas name, logo, https://billyatlas.com, and the software, design, text and other material we create for the Platform are owned by us or our licensors and protected under the Copyright Act 1968 (Cth), the Trade Marks Act 1995 (Cth) and other applicable law. Using the Platform doesn't give you any ownership or licence in our intellectual property beyond what's needed to use the Platform as intended.

When we recommend a creator to a brand, or surface a brief to a creator, we're making a suggestion based on the information available to us at the time. We don't guarantee that either side is accurately represented in every respect, that a conversation will happen, that a deal will be reached, or that any deal reached will deliver a particular outcome.

Creators can optionally connect an Instagram account through Meta's official authorisation flow. When you do, we import certain metrics and label them as platform-connected. Your use of Instagram, and any other third-party platform you connect or link to, remains subject to that platform's own terms, which we don't control.

We're not responsible for the availability, accuracy or conduct of third-party platforms, including if a connection breaks, data stops syncing, or a third party changes its terms or API access.

Creator+ and Brand Pro are optional paid plans. Pricing, billing cycles, refunds and cancellation are set out in our Subscription Terms. Payments are processed by [PAYMENT PROVIDER TO BE CONFIRMED]; we don't store your full payment card details.

We can suspend, restrict or terminate your account if you breach these Terms, the Acceptable Use Policy, or any role-specific terms, if we reasonably believe your conduct puts other users or the Platform at risk, or if we're required to by law.

• Where practicable, we'll tell you the reason and give you a chance to respond before acting.
• For serious breaches, or where the law requires immediate action, we can act first and explain afterwards.
• You can close your account and stop using the Platform at any time, for any reason, by contacting support@billyatlas.com.

Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or any other law that cannot lawfully be excluded, restricted or modified. Where our services are of a kind ordinarily acquired for personal, domestic or household use, the consumer guarantees apply in full. Any limitation in these Terms applies only to the extent the law allows it.

To the maximum extent permitted by law, and subject to section 12 above, Billy Atlas is not liable for indirect, consequential or special loss, or for loss of profits, revenue, opportunity or business, arising from your use of the Platform, including from any introduction, brief, profile, recommendation, or interaction with another user.

We provide the Platform as a discovery and introduction tool. We're not liable for the conduct of other users, the accuracy of information they provide, or the outcome of any deal they reach with each other.

You agree to indemnify us for reasonable loss we suffer as a direct result of your breach of these Terms or your misuse of the Platform, to the extent that loss was reasonably foreseeable and caused by you. This indemnity doesn't extend to loss caused by our own negligence or breach.

We can update these Terms from time to time — to reflect changes in the law, in the Platform, or in how we operate. We'll give you reasonable notice of changes. For material changes, we'll ask you to re-accept the updated Terms before you can keep using the Platform.

We introduce creators and brands. We don't manage the deal, hold the money, or guarantee the outcome. Be honest, be respectful, and if something goes wrong, tell us first. Your consumer rights under Australian law are always protected — nothing here takes them away.
